The "www.scenic.renault.com" site is a free site accessible over the Internet (hereinafter called "the Site"), making it possible, in particular, to sign up for the "My Scénic Family" creation Module (hereinafter called "the Module") and for the user to post one or a number of photos of themselves online on the Site, these being intended to represent them within the context of the Module.
Using the Site, registering for the Module and posting photos online implies the express, full and entire agreement of the Site user (hereinafter called "the User") to the Site's general conditions of use (hereinafter called "the Conditions of Use"). Consent is obtained through the User ticking a box under the Module registration form. If the User does not agree with the clauses stated below, they are asked not to sign up for the Module and not to use the Site.
Renault France furthermore reserves the right to modify the Site and/or amend these Conditions of Use at any time and without prior notice. Such changes are imposed upon Users, who should regularly consult the Conditions of Use before connecting to the Site. All changes will come into force from the time they are posted online and will, immediately and without any formality whatsoever, apply to current or future connections to the Site.

Using the Site:
2.1. Taking part in the Module requires the User to register their participation. When registering, the User must give the Publisher accurate, up-to-date and complete information concerning themselves. If the information provided should prove to be inaccurate, incomplete or out-of-date, the Publisher reserves the right to suspend or cancel the User's registration.
2.2. Registering for the Module requires a password to be created. The User is therefore responsible for the security and use of all the passwords they employ on the Site. The User must take the necessary measures to ensure these are confidential, kept safe and not disclosed to anyone unauthorised to use them. The User is also responsible for anything that may happen when logged in their name and with their user account. They must alert the Publisher immediately if there is reason to believe that their password is or may be known by someone not authorised to use it.
2.3. In order to take part in the Module, the User must create their family and upload it to the Site.
The User therefore undertakes to act fairly and guarantees:
- That the photos uploaded are originals and were taken exclusively by themselves;
- That the photos do not pirate pre-existing works generally and guarantees not to upload items which infringe third party intellectual property rights and/or copyrights, especially in respect of artistic/literary copyright, trademarks, the right to use images of people and so on;
- They and they alone are the person in and/or represented in the photo uploaded; failing this, the User guarantees that they have all the necessary licences, especially in respect of the right to use the image of the people represented and, with regard to minors, that they have permission from those with parental authority over the child or children represented;
- Not to usurp the identity of anyone when registering for the Module.
The User is therefore responsible for the photo they upload to the Site and guarantees the Publisher against any action or recourse relating to the photos uploaded.
Should anyone have reason to think that another person is usurping their identity or infringing a right of which they are the holder, they shall immediately inform the Publisher so that the latter can take all appropriate measures.
Any registration and/or photo presenting a suspect character will entail participation in the Module being null and void.
2.4. The Site may only be used for personal, and not commercial, purposes.
2.5. Under no circumstances may the User amend, copy, distribute, forward, give out, display, reproduce, edit, publish, issue a licence, create derived works, transfer or sell Site information, items or services in any form whatsoever.
Obligations of Site Users:
Users of the Site undertake to comply with the laws of France in force and to respect the rights of third parties and the provisions of these Conditions of Use.
They therefore undertake to act fairly and in particular guarantee:
- That all the items making up the photos uploaded to the Site were personally and exclusively taken by the Users;
- Not to hold or submit opinions or disseminate, in any form whatsoever, content contravening the rights of others or that is defamatory, insulting, obscene, offensive, violent, that incites others to violence or that is political, religious, racist, sexist, xenophobic, and generally any content that is contrary to the laws and regulations in force in France, human rights or not in keeping with good moral standards;
- Not to indicate or disseminate, in any form whatsoever, information or content incorporating links to third party sites;
- To disseminate only fair information.
Any infringement of these obligations constitutes a serious breach that may lead to legal action.
Notifying a breach
The Publisher advises Users of the existence of a functionality by which they can notify a breach.
When a potential breach is notified, the agency will then analyse the profile concerned and the content of the items registered. The agency will decide whether or not to carry out an online deletion of the items uploaded to the Site.
The Publisher is not, in any case, obliged to disseminate the items uploaded to the Site and reserves the right to disregard any registration that might not seem to it to comply with the stated requirements.
The agency, hereinafter called the "Moderator", will therefore be able to:
- Check registrations in principle and reject all forms that are inaccurate, vulgar, that do not comply with the spirit of the Site or that do not visibly match the features of the person registered;
- Reject all registrations that do not comply with the spirit of the Site, in particular due to their being defamatory, insulting, obscene, offensive, violent or inciting others to violence, or their being political, religious, racist, sexist, xenophobic, and generally being contrary to the laws and regulations in force in France, human rights and not in keeping with good moral standards;
- Reject registrations infringing the rights of third parties.
Intellectual Property:
The presentation and content of this Site constitute a work protected by the laws in force on intellectual property, of which the Publisher is the holder. The representation and/or reproduction of all or part of the items making up the Site is strictly prohibited.
No reproduction and/or representation of the Site, in part or in its entirety, and/or of all or part of the items on the Site shall be made without the prior written agreement of the Publisher on pain of constituting a pirating offence.
No commercial exploitation of the data presented on the Site, even in part, shall be made without the prior written agreement of the Publisher.
Any reproduction, use and/or modification of the marks, logos, slogans and other distinctive signs reproduced on the Site that may be made without the prior written agreement of the Publisher is liable to constitute a pirating offence.
Responsibility:
6.1 The Publisher shall endeavour to ensure that the Site and its content are reliable. Should Users notice errors or omissions on the Site, however, they are asked to let the Publisher know by writing to RENAULT FRANCE, ADDRESS
6.2 Consultation and use of the Site is the User's responsibility. Consequently, the Publisher could not be held liable for damages of any nature whatsoever that might result from access to and/or use of the Site and the information contained on it. It is up to Users to take all appropriate measures to protect their material and data. Users are also advised that the Publisher may need to temporarily suspend access to the Site for technical reasons, especially in order to carry out site maintenance, without any objection being able to be made in this regard.
6.3 When using the Site, Users agree to exempt the Publisher and its partners from liability and to guarantee them against all damages, costs and expenses, including legal costs arising from:
- any claim in respect of the infringement of intellectual property rights or press offences relating to the information posted on the Site;
- any activity relating to the Internet accounts opened on the Site by Users, including any negligent or fraudulent conduct or that of anyone using the Site via Internet accounts;
- the infringement of this Site's Conditions of Use;
Protection of personal data:
7.1 The Publisher reminds minors that they must have the prior agreement of their parents or legal representatives before passing on their personal data within the context of registering for the Module. The Publisher similarly encourages parents to regularly check and control what use their children make of online activities.
In accordance with amended French Data Protection Law no. 78-17 of 6 January 1978, the data collected on this Site may be processed on a paper medium or undergo automated processing on computerised files for the purposes of managing Users' participation in the Module.
Users are consequently reminded that they may object to the processing of their personal data and that they have the right to access, amend and delete these data simply by sending a written request to Renault France – Address.
The data gathered are exclusively for use by Renault France.
7.2 The Publisher also advises Users that the Publisher may need to measure the number of web pages viewed, the number of visits and the activity of visitors to the Site as well as how often they return. To this end, the User will be able to make use of the cookie technology offered by the Site's Host server. Cookies do not contain any data enabling Users to be identified personally. Users are nevertheless advised that they may object to cookies being recorded by configuring their computer according to the procedures explained on the Internet site of the Commission Nationale Informatique and Liberté at the following address: "www.cnil.fr".
The Publisher may also need to analyse how often the Site is visited by using connection data. The IP addresses relating to consultations are not stored by the Publisher.
7.3 The Publisher asks Users to consult the Internet site of the Commission Nationale Informatique and Liberté at the following address: "www.cnil.fr" for all information concerning the protection of personal data.
8. Legal provisions:
The Site and its content are subject to the provisions of the laws of France. Although the Site is accessible to other users, the Site and its content are strictly intended for access to Users living in French territory (including Corsica and France's overseas departments and territories).
